It is my understanding that you can appeal to the IRS appeals office. You should receive a 30 day letter from the IRS auditor informing you that you have 30 days to exercise your appeal rights. Once your appeal is properly and timely filed, it can take 9 months to a year before it is heard. During that time period you may be able settle the tax case before any final decision is rendered.
