If a guy gets his 17 year old girlfriend pregnant and they are only 13 months apart in age, and she will be 18 soon and will only be 3 months pregnant, then can he be arrested or her parents file charges? We live in California.

Pregnancy is circumstantial evidence of intercourse, so if you are pregnant under age, unless you are the Virgin Mary, someone has committed stat rape and can theoretically be arrested and prosecuted. If the girl love the guy, she should shut up and then there will be no evidence. But people generally cannot shut up, thinking talking to government makes things better. It never, ever does.

The short answer is yes. Consensual intercourse with a minor is what is commonly referred to as statutory rape. In this situation, it is a misdemeanor. Any criminal violation subjects the accused of being arrested, but I don't see that happening here unless there was a lack of consent or force used, something like that. If the situation is reported to the police by the parents (or anyone else, say school officials who may be required to report it), then the police will probably do an investigation and the DA will decide whether to file the charges. In these situations it is helpful to the couple, and certainly to the guy, if the parents are supportive. I don't mean to frighten you, but if it does get reported and the police get involved, the guy should immediately consult with a criminal defense attorney before making a statements to the police.

Its illegal for an 18 year old to have sex with a 17 year old in California. The parents can REPORT it to the police, but they cannot arrest you. This is a misdemeanor crime in california. Not that serious. It depends on if the police feel that its important enough to pursue or not, but the punishment for this crime is not typically very serious, especially if you have no prior record, are responsible, and demonstrate your good citizenship to the court.

    The decision to file charges isn't up to the victim's parents, it's up to the DA. If the victim's parents call the police, then cops will investigate and prepare reports. Their reports will be submitted to the DA for a decision on whether or not to file charges. If you're over 18 and the victim is under 18 but you're within 3 years in age, you will probably be charged with a misdemeanor. Call a lawyer right away.
