Can a family go as refugee from USA to Canada as fake like coming from Afghanistan? My family is living in USA, they have no insurance and nothing but green card since they had been sponsored .But I want to know that, is there any possibility to go to Canada as visitor and tell the Canadian government that we came from Afghanistan and would like to have asylum and become refugee in here? And also another question, once my family gets in Canada and the government accepted them as refugee, after that is it possible for my family to bring some of their young children who remained in Afghanistan? Does this case work?

No it does not. This is because of the concept of "firm resettlement." It is also a lie to engage in this kind of behavior. There are no refugees from the US anywhere in the world. Your family has been given the privilege to live in the US (arguably the best place to live in the world, pardon my bias) and it is engaged on a path to citizenship and you want to claim refugee status in Canada because your family does not have insurance? Coming to the US does not mean being given everything for free; but it means that you now have the OPPORTUNITY to design your life in any reasonable way that you like. Think about it. What I am trying to tell you is that you already have every opportunity to get the things that you want for your family right here in the US. Stop gaming the system for freebees.

Have you applied for asylum in the U.S.? No need to leave and come back to do that but must file within one year of arriving here. There is an agreement between the U.S. and Canada so individuals will not forum shop and must apply in the country where they first arrive.

First, you should contact an attorney who is licensed to practice law in Canada regarding questions of Canadian refugee and immigration law. Canadian law and U.S. law are vastly different. Second, regardless of what country you seek refugee status, your family should not provide false or misleading information. No. Once a person is granted refugee status or asylum in a country, he cannot become a refugee in another country. If the second country finds that the applicant lied about this, they may cancel the status given. The relatives who remained in Afghanistan should apply to come here to join you directly.

The answer is no. Refugee laws are pretty straight forward about one thing: if you established residency (and you did by becoming legal permanent resident in USA) in the country other than the country of your persecution you cannot claim status of refugee in some other country. When applying for asylum you cannot submit false information otherwise your immigration benefit will be denied to you and you may be subject to criminal liability therefore you cannot be deceptive about where you come from. As legal permanent resident in the United States you can petition the government to bring your children to the United States and enjoy many benefits that permanent residency offers you in this country.

This sounds like blatant fraud. I highly recommend that you do not do this unless you want your entire family facing removal charges in the US and worse. I am not even sure if this is a real question but if it is, that is a very, very bad idea.
