Can a divorced parent with two children move in with a girlfriend in Tennessee? 2 Answers as of February 10, 2011

My husband and I divorced a little over 6 months ago. We have joint custody of our two children and share equal amount of time with them. However, he is moving in with a girlfriend and the children will have to live with an unmarried couple. Is this legal in Tennessee?

It is not illegal for children to live with an unmarried couple. Unless your ex is contractually precluded from living with another woman, per your Divorce Decree and Parenting Plan, there is nothing to prevent him from moving in with his girlfriend. You could petition the court to modify that parenting plan, however.
