Can a deferred action recipient petition his spouse? 3 Answers as of April 28, 2015

I’m a tourist. I came legally to the US with my B1B2 visa. I met my boyfriend and he is a DACA recipient. We both want to get married but we don’t know if he can petition me as his wife. Thanks.

No. A DACA recipient cannot extend his benefits to his spouse. It is only for himself.

DACA does not convey residency or citizenship on the DACA recipient. It only allows him to stay and work in the U.S. legally for a specific period of time and then he must renew his DACA status. Therefore he is unable to petition you, or anyone else, for permanent residency.
