Can a DA make untrue statements during sentencing? 1 Answers as of June 21, 2011

My daughter was being sentenced, and during the DA's statement he said that my daughter had done 3 home invasions. He didn't say that she had been convicted nor just charged, neither of which is true. She has never been charged nor convicted of such. Is it legal for him to say this if it isn't true?
