Can someone sue for breach of contract because a business failed to respond to multiple calls/emails? The business in question (now out of business, however not through bankruptcy) offered a warranty for a product that provided annual service of the product. The customer tried to contact the company after 6 months for service and no warranty service is due or needed at this time.

If a company sells a product with a warranty and then goes bankrupt he customer will find it very hard to get the product serviced, repaired, or replaced. They can try to sue in small claims court if hey can find someone to sue, but that would be difficult Unless the problem is worth a lot of money both parties should just forget about it. One reason to buy reliable products from well established manufacturers is that they will be there years down the road to honor the warranty.

You can sue the business who sold it. They warrant by being in business and selling the product that the warranty that goes along with the product must be honored. you can also sue the manufacturer on the same warranty.
