Can CPS take my child because of prior cases? 2 Answers as of December 09, 2011

CPS took my baby at the hospital. However, I tested negative and so did the baby. They said they were taking her because I had two children taken within five years and that’s apparently the law. Is this legal?

Cps is there to protect the children. If they have information, or see something where they take action, they will do it. If other children have been taken they are concerned about this new baby. Best to do exactly what they want and when they see everything is ok then they will leave you alone. Their concern is for the safety of the child.

There is a presumption that where a parent has been deemed to be a danger to one or more children, they will be a danger to other children. However, you must contact an attorney immediately to show what services you have received to remedy the issues that made you lose custody of the prior children. You must also take any services offered for reunification with the previous two children as well as the infant.
