That depends on the judge. Each case is different, but there would have to an issue of current substance abuse for the court to consider it.

In California, you may be ordered to submit to a urine test for drugs and alcohol in a custody matter. The Court can ask you to submit to a follicle test, but the Court CANNOT order that you participate in a hair follicle test. You should consult with an experienced family law attorney in your area.
