Can clothing qualify for a utility patent? 2 Answers as of September 22, 2010

Without going too far into specifics, I am in the process of inventing a new article of clothing that will be far more comfortable and functional than existing models. Can clothing such as this qualify for a utility patent?

Yes most certainly. In fact, just the novel aspects of the clothing can be patented to give you broader protection. You can use a utility patent or a design patent. Nike often uses just design patents on its new shoes and only claims specific aesthetic features such as the way the side of the sole looks. Design patents run about $1200 vs $8000 for a utility patent. Feel free to visit my website for more information.
