There are requirements that the court imposes upon the parties before any judgment can be submitted for approval. One of those requirements is that you was exchanged (and notify the court that you've successfully exchanged) disclosure statements between you. You have every right to divide property unequally as long as all the property and debt has been identified and you have done the disclosures in accordance with CA law.

You can agree but the court will have to approve it to be enforceable as a judgment.
