Can 'being nervous' be a defense for sobriety test? Posted on July 14, 2011
I had only had 2 drinks and was tired when I got pulled over. The only reason I failed the field test was because I was so nervous and it was my first time being pulled over. Is this a defense that can get me off considering I blew below the legal limit but was charged because I passed the field test?
