I have a check written to the estate of my father, which does not exist, from the estate of my grandmother, does exist. My father passed in September with no will, no assets, no nothing really, so we never opened a trust or estate account. Now, a home that my grandmother sold and my brother and i split the portion of my fathers inheritance, yet he passed in September. My uncle is the signer on my grandmother's estate and refuses due to legal advice and tax purposes to re write the check to my brother and I. So here we have a check written to an estate that has never existed? What to do? We need them to write the check to us.
