My son has a child with his ex-girlfriend who had since remarried. They share joint custody. He just learned his ex-girlfriend husband beat her up and now there is a restraining order keeping him away from his wife and my granddaughter. Your question is a little confusing, but a restraining order would only be against the party to the case. You are a third party. Your son could get into trouble if there is a restraining order and he attempts to use you to contact her in violation of the restraining order.

Restraining order are personal to the individual that is restrained. Unless the case is confidential, you can ask at the clerk's office in the county where the restraining order was issued to give you a copy of it. You can do a search by name in most counties to see if there was a case and if the restraining order was issued. Many counties have this search available online, sometimes for a cost, and also many counties, such as Los Angeles, have kiosks in most courthouses where you can run a search in their name index to see if there was a restraining order file and granted.

You are asking two different questions. As to finding out about a restraining order, go to the court in the county in which they reside and check the civil register of actions. In many counties you can access it on line. As to your wanting to visit, it is unclear if there is any sort of restraining order against your son. If not, then you can certainly visit her on your son's time with his permission.

Domestic Violence files are confidential files at the court, so you would not have access to those records through thee court clerk. Your son should ask his child's mother for a copy of the Domestic Violence Restraining Order that she has against her husband.

Yes, You can go to the court in the county where the alleged assault took place to see if there is a record of a restraining order. You should also be able to check with the police or sheriff's office to see if there is a domestic violence restraining order. If there is a restraining order, your son may need to go to court to get some supervised parenting time. Unfortunately, your rights pretty much exist under his rights. He might be able to get an order where you would be the supervising agent if there is a dometic violence restraining order.
