Am I right to file against my landlord? 1 Answers as of July 25, 2011

Landlord has filed an unlawful detainer due for non-payment of rent. I withheld my rent due to landlord refusing to supply my request for receipts for all moneys paid to her from May 2011. Also failure to send 3 day notice in appropriate time. They sent it to me after 3 days were already up.

You cannot legally withhold rent because you did not get a receipt for previous payments. I do not understand your 3-day issue. They can serve you with a 3-day notice if you are late, even if they wait more than 3 days to serve you with it. As long as they then serve the UD after giving you 3 days to pay, they are doing things properly.
