Am I responsible for taxes my husband owes? 3 Answers as of November 24, 2010
If my husband does not pay his taxes, am I legally responsible for them? I can afford to pay mine, but I cannot pay all of his too. Getting divorced for taxes reasons seems stupid, but we cannot both get sucked into poverty.Free Case Evaluation by a Local Lawyer!

Generally, spouses who file a joint tax return are liable/responsible for any taxes owed. If you file "married, filing separately" you may be secure from his tax obligation. I would recommend speaking with a tax attorney and/or CPA as there are numerous other factors
that can be involved.

If you file jointly, you are jointly liable for tax liability even if the taxes are due to your spouse's income. You can file to the IRS for innocent spouse protection but that protection is limited and very fact dependent.
