A letter from the IRS is regarding my mom who died in 2010. They say that my mom's 2009 was incorrect and I don't know what to do. Should I send them a letter stating that she died in 2010? Was a probate actually opened? If no probate was opened and there are no estate assets, then the IRS may be out of luck. However, if there is an estate that has been opened, the IRS may be entitled to be reimbursed out of the estate assets. If an estate was opened, you should consult the attorney that is helping you with the estate.

As I am sure your attorney explained (and no one should be an executor without one) you are responsible for (1) the debts of the estate, and (2) tax returns. You cannot give anything to heirs until you deal with this. As Executor you should now retain a tax lawyer or CPA to assist your estate lawyer.
