Am I responsible for the debits of deceased spouse? 3 Answers as of May 02, 2011

I separated from my spouse for 10 years. She recently passed away with zero estate. Had accumalated nursing home care bills. I am retired and live on S.S. only. Am I still responsibe for her debits?

It may depend upon what state you live in as to whether living separate and apart is sufficient without a formal legal separation so you are not responsible for her debts. However, creditors cannot attach Social Security benefits, so even for example, if they were to ever sue and win, the Social Security cannot be used to pay the judgment.
