No, it is not the refusal that incriminates you, it is: (1) the noticeably poor driving that led to the traffic stop (unless you were pulled over in a DUI roadblock); (2) the odor of alcohol emanating from your person; (3) your inability to perform the field sobriety tests; and (4) whatever other stuff you were doing when the police pulled you over.
