Jury Deliberations Expected in Mehserle Trial

Despite postponement, jury deliberations in the murder trial of former police officer Johannes Mehserle are expected to take place this week.

The 28 year old Mehserle, a former police officer for the Bay Area Rapid Transit (BART) district, is on trial for murder after killing 22 year old Oscar Grant III on the Fruitvale BART platform on New Year’s Day 2009. Mehserle maintains that he was meant to use his tazer against Grant, who he mistakenly believed had a gun.

Los Angeles Superior Court Judge Robert Perry declared last week that the shooting could not constitute first-degree murder because it was not a premeditated act. Now the jury must decide whether Mehserle is guilty of second-degree murder, voluntary manslaughter, involuntary manslaughter, or if he should be acquitted.

The highly publicized case is being tried in Los Angeles because of fear that the scorching public anger in the Bay Area would result in an unfair trial.
